Dell & Microsoft “Ultimate Tech Challenge”: Servers




1. Eligibility: The Dell & Microsoft “Ultimate Tech Challenge”: Servers (the “Competition”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Dell Marketing L.P., Dell Inc., Zócalo Group, LLC and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Employees of the City of New York are not eligible. Government employees, including all federal, state, county, city or municipal government employees and K-12 employees are not eligible. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Competition. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Administrator: Zocalo Group, LLC, 200 E. Randolph Street, 42nd Floor, Chicago, IL 60601.

4. Timing: The Competition begins on Wednesday, December 11, 2013 at 8:30 a.m. CST and ends on Thursday, December 26, 2013 at 11:59 p.m. CST. The Competition consists of two (2) phases as set forth in the chart below.

Submission Phase

  • Starts at 10 a.m. CT on December 11, 2013
  • Ends at 11:59 p.m. CT on December 26, 2013

Selection Phase

  • Starts at 10 a.m. CT on December 27, 2013
  • Ends at 11:59 p.m. CT on December 31, 2013

5. How to Enter: During the Submission Phase, Dell will post the following Ultimate Tech Challenge question: “How do you best use SSD as storage option with Microsoft Windows Server for optimal performance and cost?” The question will be posted on the following various IT websites and forums, which include but are not limited to: Spiceworks, Dell Tech Center, Stack Exchange, Daniweb, ServerFault, and Super User. Participants may submit their Entry in one of two ways: 1) by posting their answer as a comment on any of the individual sites on which the Ultimate Tech Challenge: Servers is posted, or 2) by emailing their Entry to Both forms of entry are equally acceptable, and one form does not increase Participants’ Entrants’ chances of winning over the other. The Sponsor, in its sole discretion, may remove your Entry and disqualify you from the Competition if it believes, in its sole discretion that your Entry fails to conform to the Guidelines and Restrictions.

Response Guidelines:

  • The response must be posted only on sites and forums on which the Ultimate Tech Challenge: Servers is posted;
  • The response must answer the question regarding Ultimate Tech Challenge: Servers: “How do you best use SSD as a storage option with Microsoft Windows Server for optimal performance and cost?”.

Content Restrictions:

The response must be original and accurate;

  • The response must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • The response must not contain images or artwork not created by entrant;
  • The response must not depict any third party from which the entrant has not received permission to be depicted;
  • The response must not contain material that is pornographic, profane, inappropriate, indecent, obscene, threatening, harassing, hateful, intimidating, abusive, tortious, defamatory, slanderous or libelous;
  • The response must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
  • The response must not encourage conduct that would constitute illegal activity, give rise to civil liability, or otherwise violate any local, state, national or foreign law, including any right of publicity, right of privacy or any other proprietary right of another; and
  • The response must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where film is created.

For all Entries: All Entries will become the exclusive property of Sponsor, and none will be acknowledged or returned. Submitting an entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Submission. Sponsor is not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected Entries, which will be automatically disqualified. Limit: Each entrant may submit one (1) Entry during the Submission Phase.

In the event of a dispute regarding any Submission, the authorized account holder of the email address used to register on the website or forum will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.

6. Winner Determination: Winner will be determined via the process set forth below. (a) Judging & Grand Prize Determination: During the Selection Phase, a select panel of Dell and Microsoft employees will judge the entries to select one (1) Grand Prize Winner.

(b) Judging Criteria will consist of:

  • “Best technical solution and advice, as relevant to the question.” – 25%
  • “Best innovative and creative response to the question.” – 25%
  • “Most valuable response to the question.” – 50%

7. Grand Prize Selection: Sponsor’s and/or Administrator’s decisions as to the administration and operation of the Competition and the selection of the potential winners are final and binding in all matters related to the Competition. On or around December 27, 2013, a panel of Dell and Microsoft judges will select a Grand Prize winner according to the Judging Criteria, outlined above. Potential winners will be notified by email. These email notifications will be sent on or around January 30, 2013. Each potential winner (parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return to Sponsor, within five (5) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release and a valid W9 form (for prizes exceeding $600 in approximate retail value) in order to claim his/her prize. If a potential winner cannot be contacted, fails to sign and return the Affidavit of Eligibility, Liability & Publicity Release and valid W9 form within the required time period, or prize is returned as undeliverable, potential winner forfeits prize. Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. By entering, entrant agrees he/she is in compliance with all of his/her employers’ rules, policies, and procedures that relate to accepting prizes. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to the entrant with the second highest number of votes by the Dell and Microsoft panel of judges. Only one (1) alternate can be chosen, after which the prize will remain un-awarded.

8. Prizes: One (1) winner will be chosen based on final selection from the Dell panel of judges and will receive a Dell™ XPS™ 12 Ultrabook™ Touch. The Approximate Retail Value of this prize is $899.99, but subject to change based on, among other things, normal price fluctuations associated with the consumer marketplace. In addition, the winner and his/her response will be featured in a white paper that will be composed for the “Ultimate Tech Challenge” on servers. The winner will be contacted by Dell Inc., Microsoft, and Zócalo Group, LLC via phone and email as follow-up to coordinate his/her contribution to this white paper.

Prizes are non-transferable and no substitutions will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.

Limit: One (1) prize per person.

9. Release: By entering, entrant agrees to release and hold harmless Dell Inc., Zócalo Group, LLC, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Competition or receipt or use or misuse of any prize.

10. Publicity: Except where prohibited, participation in the Competition constitutes winner’s consent to Sponsor’s, Administrator’s and their agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

11. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Competition, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Competition, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Competition; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Competition; (4) technical or human error which may occur in the administration of the Competition or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Competition or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Competition, provided that the Entry Period has not ended. If the Competition is canceled, suspended or modified, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

13. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by United States District Court for the Western District of Texas and the Texas State District Court in Williamson County, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.

14. Entrant's Personal Information: Information collected from entrants is subject to Dell’s privacy policy, Zócalo Group’s privacy policy and Microsoft’s privacy policy.

15. Winner List: For a Winner List, send a hand-printed, self-addressed, stamped envelope to “Dell & Microsoft ‘Ultimate Tech Challenge: Servers’ c/o Nicole Castanon, One Dell Way, Bldg 2, Round Rock, TX 78628. Winner List requests must be received by 2/28/13.
